OmaMehiläinen Terms of Use

All parties who have registered user accounts (i.e. profiles) in the OmaMehiläinen service (“OmaMehiläinen” or “the Service”), who give someone access to their own user account or provide information to OmaMehiläinen or otherwise use OmaMehiläinen or information obtained from OmaMehiläinen concerning themselves or another person (“the User”) accepts and agrees to comply with the applicable OmaMehiläinen Terms of Use. The Terms of Use apply to both the OmaMehiläinen online service and mobile application. The online service and the mobile application may differ from each other. Mobile applications of different operating systems may also differ from each other. As the Terms of Use can be updated from time to time as described in section 12, the Users are encouraged to review the Terms of Use on a regular basis.
OmaMehiläinen is a service provided by Mehiläinen Oy (“Mehiläinen”), which enables the storage and viewing of information related to health and well-being and the development and transmitting of information about services related to health and well-being. OmaMehiläinen also provides health care and other services.
The User can store, transfer and process data related to their own health and well-being, such as vaccination data, self-measured weight or blood pressure readings, and data and documents related to doctor’s appointments and examinations outside Mehiläinen. The information stored by the User is not available to a health care professional providing services at Mehiläinen (“the professional”), unless the User expressly authorises it in the OmaMehiläinen service. The User granting permission does not mean that the professional reads the data automatically or proactively in connection with the treatment event, therefore, the User must individually agree with the professional at each treatment event that the professional will become familiar with certain data stored by the User in OmaMehiläinen. The professional decides on a case-by-case basis whether to include this information in any part in the separate patient register maintained by Mehiläinen. The data stored in OmaMehiläinen by the User are not patient data in the sense that their processing would be subject to the same obligations as those applicable to the patient data stored by a professional in connection with appointments, procedures and examinations. However, the User may separately agree with the professional that the data will be used in connection with the treatment, in which case the professional can store data from OmaMehiläinen in a separate patient information system in connection with the treatment.
OmaMehiläinen is separate from the patient information system maintained by Mehiläinen, which covers patient information about the treatment and examinations provided by Mehiläinen and the private practitioners operating at Mehiläinen. OmaMehiläinen, however, gives the User the right to view the patient information and visit history stored in Mehiläinen medical clinic, hospital and working life services and oral health care at Mehiläinen Group’s clinics. However, the visibility of the data may be partially limited for therapeutic reasons. A person registered for the Service may be granted, with the consent of another person or on the basis of a custody relationship, the right to view and process the data of another person registered in the Service, which are stored personally, and partially limited data of Mehiläinen’s patient register. The User can store and update their personal and contact information as well as their prohibitions and consents in the service in terms of OmaMehiläinen, their customer relationship regarding other Mehiläinen’s services and the separate Mehiläinen patient register. Mehiläinen also automatically updates the customer’s contact information based on information received from the Population Register Centre.
The User can send, to a limited extent, a message via OmaMehiläinen to a professional working at Mehiläinen who is treating them.
However, reading the message sent in this way is not guaranteed, so if the matter is important or urgent or if the reception must otherwise be ensured, the User must always make an appointment through the normal Mehiläinen’s appointment service or otherwise ensure proper processing of the information contained in the message. Mehiläinen has the right to direct and restrict the sending of messages only to a specific person.
The OmaMehiläinen service provides the services of the digital medical clinic, Digital Clinic. The use of the Service is based on the customer relationship with Mehiläinen, its partner or a public primary health care provider. Some customer relationship information, such as voluntary insurance information, is managed in the OmaMehiläinen service’s My Information section. The services of the Digital Clinic can be provided by Mehiläinen’s professionals, private practitioners or Mehiläinen’s partners. Some of the services are subject to a fee. Examination referrals made in connection with Digital Clinic visits, which are charged to the User according to the current price list, are also considered as services subject to a fee. Some of the services are reimbursable by Kela. For these services, Mehiläinen has a direct compensation agreement with Kela. As a rule, the services provided by professionals consist of handling one issue at a time. If the visit concerns several separate issues, we reserve the right to charge for each issue individually. If your issue is not suitable for handling at the Digital Clinic, we will refer you to the right care and will not charge you for the visit. However, we reserve the right to charge a fee for your visit if your issue requires more extensive familiarisation from the doctor or the doctor provides treatment instructions. We also reserve the right to charge for non-therapeutic discussions. The professionals provide services in Finnish and English.
According to a policy issued by the Ministry of Social Affairs and Health in 2015, remote health care services are covered by patient insurance similarly as the traditional services. However, patient insurance cover applies only to health and medical care provided in Finland. Remote medical treatment is considered to have been provided in Finland if both the patient and the health care professional providing the treatment are physically located in Finland. The Patient Injury Act does not apply to a treatment event if the patient or the attending doctor is abroad at the time of treatment, with the exception of a temporary stay and a treatment relationship that has begun in Finland. The doctors of the Digital Clinic are always physically located in Finland.
The Service includes, at Mehiläinen’s discretion, service and reminder messages sent to an email address, mobile phone number and/or mobile application notifications, for example, a reminder of booked appointments, notification of the completion of examination results or professional’s message from the Digital Clinic. The User may prohibit the sending of service or reminder messages, but the User must understand its impact, for example, on the clarity of the Digital Clinic services. The OmaMehiläinen service contains targeted, up-to-date information on health and well-being, as well as on the services of Mehiläinen or its partners. The service includes marketing produced by Mehiläinen and its partners related to the services and products they offer. The User may consent to receive up-to-date marketing communications about the products and services of Mehiläinen or its partners by email, mobile phone or post. When registering for the service or whenever logging in to the OmaMehiläinen service, you can make more detailed choices concerning the messages you receive. You can always withdraw your consent to direct marketing in the My information section. The Service may provide information about third party services or links to such services.
A fee may be charged for the OmaMehiläinen service package or the separate services included therein in accordance with the current price list in the OmaMehiläinen service. In addition, the User is charged a fee for services that may be provided via OmaMehiläinen by a professional working at Mehiläinen. This fee is a time-based fee or another charge in line with the valid price list. If there is a separate agreement on communications, for example, in the occupational health agreement between the User’s employer and Mehiläinen and the service is included in the agreement (the User must confirm this beforehand), the terms of the agreement in question shall be applied. If the Service is not included in the referred agreement, the User must pay for the Service themselves.
The services purchased directly from the OmaMehiläinen service are charged to the payment instrument indicated by the customer, the details of which are provided to the payment service provider used by Mehiläinen. Mehiläinen is not responsible for matters related to the transmission of payments, but each payment service provider is responsible for them. If the payment service provider is unable to charge the payment instrument you have indicated, we will send the invoice details to the email address you have provided. If we are not able to charge the payment instrument you have indicated and we do not receive your payment on the invoice sent to the email address you have provided within the payment period, we will initiate the collection procedure in accordance with our usual practices. If the User utilises third-party services communicated through or conveyed by OmaMehiläinen, the price list and terms of the third party shall be applied. The User is responsible for the costs resulting from their own data connections, hardware and software.
Registration with the service requires the person to have a Finnish personal identity code and personal online banking credentials accepted by Mehiläinen or other means of strong authentication, unless otherwise stated below. After the registration, the authentication to the OmaMehiläinen mobile application can also be carried out via a separate user ID created in the service. The registration and access rights are linked to a specific individual, so the User must always use their own personal information and personal identification data for logging in to the user account.
A minor without online banking credentials cannot register for the service on their own. The child’s legal guardian can register the child’s Service to the family profile and use the Service on their behalf, only, however, on the following conditions, which the guardian is obliged to comply with at the time of registration and every time the Service is used on behalf of the child. In the Service, the guardian can view, add and otherwise process information on the child in the same manner and extent the guardian can their own information. The child’s information is confidential and even the guardian is not generally entitled to access the information of a child. The guardian may only perform the registration and use the Service on behalf of a child under their legal guardianship and, even then, only if the guardian is entitled to receive the relevant information regarding the child’s state of health and treatment under the sections of law excerpted below and in accordance with the law in a more general sense. According to section 9 of the Finnish Act on the Status and Rights of Patients (785/1992): “If a minor patient because of his/her age or level of development can decide on the treatment given to him/her, he/she has a right to forbid providing his/her guardian or other legal representative with information on his state of health and care.” Furthermore, according to section 7 of the act (Finnish Act on the Status and Rights of Patients, 785/1992): “The opinion of a minor patient on a treatment measure has to be assessed if it is possible with regard to his/her age or level of development. If a minor patient owing to his/her age and level of development can decide on the treatment given to him/her, he/she has to be cared in mutual understanding with him/her.” The guardian must respect the child’s right to privacy in all situations. Before each use of the Service, the guardian must consider whether there is a need to discuss the intended use with the child before using the Service and assess the child’s opinion on the matter whenever this is possible in view of the child’s age and level of development. The opinion of a child under 12 years of age must always be valued if their level of development is great enough that their wishes and opinions must be considered. If the child can understand the meaning of the registration or use of the Service, the guardian or representative cannot perform the registration or use OmaMehiläinen in any other way than the one that the child has approved beforehand. The guardian is only allowed to perform the registration and use the Service in accordance with the best interest of the child. The guardian cannot register or use the Service on behalf of the child, if the registration or use is not in the child’s best interests, as may be the case in a custody dispute or if the guardian is under suspicion of assault of the child. The guardian must exercise special consideration before viewing information on the child from the separate patient register, even if OmaMehiläinen only makes limited patient register data available. The guardian cannot view information on the child without the child’s advance approval, if that approval is needed in view of the matter and the child’s level of development. The guardian must consider the use before each occasion of use, taking into account the child’s age and level of development as well as the child’s other conditions and issues. In unclear situations, the guardian is not allowed to view the child’s information or use the Service on behalf of the child. It is always the guardian’s responsibility to apply consideration beforehand and to take into account what constitutes appropriate action before each occasion of use. If the use of OmaMehiläinen is counter to the child’s best interests or otherwise prohibited, Mehiläinen must be notified of this. The child may ask the attending doctor to forbid displaying their patient record to a guardian, for example, whereupon the doctor will record the refusal in the patient information system after taking into consideration the age, level of development and health issue of the child. The OmaMehiläinen service is separate from the patient information system, and its viewing and processing rights through the Service are denied by filling in the appropriate form at the Mehiläinen medical clinic. The guardians of the child are jointly responsible for the tasks belonging to the guardians and they must make joint decisions concerning the child also with regard to OmaMehiläinen. The guardian may not register the child with OmaMehiläinen or use OmaMehiläinen without the consent of the other guardian. * The guardian using the Service on behalf of the child is responsible for ensuring that the child’s user account is used correctly in accordance with the legislation and that the other guardian’s right to be heard and other statutory rights are also exercised by consensus between the guardians.
For family profiles made before September 21, 2023, the previous service events of a child under 12 years old at Mehiläinen will automatically be visible to the guardian in their OmaMehiläinen account. For new family profiles made after September 21, 2023, a guardian can register their 12-17-year-old dependant in the OmaMehiläinen service by adding them to their own family profile, but in this case, the dependant's health information will not yet be visible to the guardian. A 12-17-year-old can grant their guardian viewing and handling rights to their health information either through their own personal online banking credentials or another strong form of authentication, or by signing a separate document pertaining to the matter. New service events will become visible to the guardian in accordance with the assessment of the minor's decision-making capacity by the treating physician and the consent given by the young person. The right granted to the guardian to view and handle information automatically expires when the dependant turns 18 years old. The granted viewing and handling rights can be revoked at any time. It is hoped that revocation will always be done through the service, but if necessary, it can also be done by signing a separate document pertaining to the matter.
Automatic checks on the validity of the custody relationship from the population register system can be made in the Service on the basis of the personal identity code according to the frequency determined by Mehiläinen, but this does not remove the guardian’s responsibility, because the guardian is always responsible for not using the data when there is no right to do so. The guardian is obliged to notify Mehiläinen of changes in the custody relationship if this results in a change in the access right to the child’s data in OmaMehiläinen.
As part of OmaMehiläinen, Mehiläinen provides a digital healthcare service through the Digital Clinic. The service providers on Digital Clinic include Mehiläinen Oy and independent professionals operating within Mehiläinen, detailed information about whom is available upon request. The Digital Clinic service can be ordered through the OmaMehiläinen application. The use of Digital Clinic is based on the individual's customer relationship with Mehiläinen, such as that of a corporate occupational health client or a public primary healthcare organizer. Customer information, such as voluntary insurance details, is managed in the 'My Information' section of the OmaMehiläinen service.
The service provided by Digital Clinic involves either a one-time remote sale of a health service or a separately agreed upon monthly subscription service. The healthcare services provided by Digital Clinic are chargeable. When initiating a conversation, the customer must confirm that they wish to start the discussion. After this, the customer still has the right to cancel the service by interrupting the conversation with a separate button until a healthcare professional joins the conversation. By starting the conversation, the customer consents and accepts that if they have initiated the conversation and have not ended it before the professional joins, the customer no longer has the right to cancel under consumer protection law after the healthcare professional has joined the conversation. If the customer cancels the service before the healthcare professional joins the conversation, they will not be charged for the service. The same applies if the issue is not suitable for treatment at Digital Clinic and cannot be resolved there. However, Mehiläinen reserves the right to charge for the use of Digital Clinic if the issue requires the doctor's more extensive involvement or if they provide treatment instructions.
The service is not intended for general appointment booking or other customer service, but only for therapeutic discussions. Mehiläinen reserves the right to charge for discussions that are not therapeutic in nature. The general practitioner service at Digital Clinic typically includes handling one issue at a time. If the visit involves several separate issues, Mehiläinen reserves the right to charge for each issue separately.
If Mehiläinen is unable to charge the visit to the customer's specified payment card, the customer does not pay the invoice through OmaMehiläinen, or Mehiläinen does not receive the customer's payment to the invoice sent to the customer's specified email address within the payment period, Mehiläinen will initiate standard collection procedures. The payment term is 14 days net.
Due to the nature, implementation, and pricing of the services, no specific response time for answering contacts or availability of services can be guaranteed. The subscriber or user does not have the right to a price reduction based on errors, delays, or other reasons, even if availability is significantly delayed. The service provider's liability is limited in all cases to the price paid for the service. Indirect damages are not compensated. Digital Clinic is not intended for use in emergency situations or other urgent circumstances where the customer should immediately contact the nearest emergency service or call the general emergency number 112.
In addition to these terms, the Digital Clinic service is subject to Mehiläinen's General Terms and Conditions for Health Services, which can be found on the mehilainen.fi website and are provided to the customer upon request. The aforementioned terms define, among other things, the user's responsibility, data security and privacy issues, and limitations of liability, which also apply to the Service. The processing and compensation of patient injury claims are carried out entirely according to the Patient Insurance Act. Remote healthcare services are covered by patient insurance just like traditional services. Patient insurance coverage only applies to healthcare and medical treatment provided in Finland. However, treatment is also considered to be provided in Finland if, during the treatment, either the patient or the healthcare professional providing the treatment is temporarily abroad for a random reason - such as a holiday or business trip - and the treatment is arranged via remote connections.

Adding insurance information to a user's OmaMehiläinen profile is a service that allows the validity of the customer's insurance policy to be verified with the insurance company. Through this service, the customer can, if they wish, give Mehiläinen consent to apply for direct billing authorization from the customer's insurance company for transactions at Mehiläinen. If the insurance company grants direct billing authorization, Mehiläinen will bill the visit directly to the insurance company. If the insurance company does not grant direct billing authorization or issues a negative compensation decision after direct billing, the customer must pay the costs incurred from their visit to Mehiläinen themselves, after which the customer can apply for possible compensation from their insurance. The insurance company makes independent decisions regarding the possible direct billing authorization and compensation decisions, and Mehiläinen is not responsible for the decisions made by the insurance company. Mehiläinen also cannot guarantee a positive direct billing or compensation decision, even if the customer adds their insurance information to their profile.
If the customer's insurance policy ends, the customer must also remove the insurance data from their OmaMehiläinen profile. Additionally, the customer can remove the insurance data from their profile at any time if they wish. Through OmaMehiläinen, it is possible to purchase various monthly subscription-based additional services. A list of available monthly subscription services, as well as the detailed terms and prices for the services, can be found at www.mehilainen.fi/en/healthmembership.
The monthly subscription services are subject to their own respective terms and conditions that are in effect at any given time, which can be found at www.mehilainen.fi/en/healthmembership. The terms and conditions of the service being subscribed to must be accepted at the time of purchase.
The Service may provide information about third party services, actual third-party services or links to such services. The User may use these third-party services via OmaMehiläinen’s links or otherwise through OmaMehiläinen, but Mehiläinen is not, even then, a party to the agreement or otherwise responsible for the information provided or transmitted by the User and third party or for its delivery. In any case, Mehiläinen is not responsible for any information, services, actions or omissions provided by the User or a third party.
The User may use and undertakes to use the Service only to support the health and well-being of the data subject and solely in the interests of the data subject and in accordance with other good practices, the consents required by the legislation and the Terms of Use of OmaMehiläinen and the orders and instructions of the Mehiläinen valid at that time. The Service may not be used for commercial purposes.
It is very important to always remember that the data stored by the User will not, as such, become available or even known to the professional, but will always have to be separately agreed with the attending professional, in which case the User must ensure that the attending professional has also processed the data that the User wanted to be processed. The User is responsible for the information provided and understands that the information provided by the User does not replace the information obtained by the professional through personal appointments, measurements or examinations.
The User is responsible for the accuracy and arrival of the data stored and processed by the User and for ensuring that only data related to the health and well-being of the data subject are stored in OmaMehiläinen for the purposes of OmaMehiläinen. The User must take all reasonable steps to ensure that the material does not contain malware or is otherwise harmful.
It is always the responsibility of the User to consider whether to conduct a personal appointment, treatment or examination with a professional. The decision and responsibility for the use and non-use of such personal service, as well as more generally OmaMehiläinen, lies solely with the User. When the User connects a legally incompetent minor to the family profile, the User accepts the Terms of Service on behalf of the legally incompetent minor and is responsible for being the legal representative of the legally incompetent minor and that the User has the right to view and process the data in accordance with the Finnish Act on the Status and Rights of Patients to the extent and for as long as the User views or processes the data of the legally incompetent minor. The User is responsible for the necessary communication with the legally incompetent minor and the other guardian.
Mehiläinen has the right to check the accuracy of persons’ names, identities and address information and the existence of dependency relationships from a population information or other known system. The personal identity code shall be used for checks. However, any checks carried out by Mehiläinen do not alter the fact that each person is always responsible for providing correct and sufficient contact and other necessary information about themselves and has the right to view and process the data of another person.
If the User detects or suspects that there is incorrect information in their own information or that of others or the use is in contravention of these Terms, the User must immediately inform Mehiläinen.
Each User undertakes to keep all non-public information concerning another person and other information obtained through the Service confidential, and not to use, display or disclose it, except under the regulations for the interests, consents and service purposes of the other person concerned.
Each User shall be liable for claims against Mehiläinen, Mehiläinen’s employees or private practitioners and for any damage caused by the User’s actions or omissions.
OmaMehiläinen enables the management of the User’s own health information and communication to the extent that Mehiläinen allows at the given time. In addition to the remote appointment services provided by health care professionals, the service may, for example, provide general and personal instructions, which do not, however, replace the personal appointments, treatment or examinations of the health care professional. Mehiläinen is not responsible for the completeness, accuracy or uninterrupted nature of the Service or for the consequences of using or not using the Service. Mehiläinen is not responsible for the functionality of the data connection and telecommunications services between the User and Mehiläinen. Mehiläinen has the right to not approve the registration and to restrict, suspend or remove content from the Service at its discretion, for example, due to load or other technical reasons or due to maintenance, suspected misuse or connection problems.
Mehiläinen produces and delivers the Service as it is available. Mehiläinen is not responsible for the costs of the User or a third party or for any direct or indirect damages to the User or a third party as a result of using or not using the Service or otherwise. In all situations, Mehiläinen’s liability is no more than what is laid down in the mandatory legislation in Finland.
Mehiläinen shall not be liable for delays or other breaches of obligations caused by reasons beyond Mehiläinen’s control, such as strikes and other industrial actions, fire, illness, interruption of electricity supply, data connections or the functionality of information systems, action under public law measure or any other reason that Mehiläinen cannot reasonably be expected to eliminate.
All rights to OmaMehiläinen belong to Mehiläinen. The User may not copy, save, reproduce, modify or transfer OmaMehiläinen. However, the User has the right to store individual information about themselves and the persons connected to the User’s profile for the purposes and in accordance with these Terms of Use.
The Service may store and otherwise process sensitive personal data. This information is confidential and may only be processed and used in accordance with these Terms of Use, laws and consents. When using OmaMehiläinen, the User accepts the valid Privacy Statement for OmaMehiläinen, which can be read on Mehiläinen’s website at www.mehilainen.fi/en/privacy-statements. The patient register maintained by Mehiläinen is a separate register from the Mehiläinen’s customer register included in OmaMehiläinen which covers patient information about the treatment and examinations provided by Mehiläinen and independent private practitioners providing services at Mehiläinen as data controllers. The information stored by the User in OmaMehiläinen about the User’s health status, treatments or examinations performed elsewhere does not, as such, become part of the patient data, but is decided by the attending professional, if so agreed between the attending professional and the User in connection with the treatment given at Mehiläinen.
OmaMehiläinen operates on the Internet and can be accessed via a secure data connection, for example, via a computer, mobile phone, tablet or other device’s browser. Mehiläinen also has the right to provide the service through another technical application. The User understands and accepts that network and mobile services may involve risks. The User is responsible for the appropriate information security of their own devices, operating environment, identifiers and operations. OmaMehiläinen is logged into using personal online banking credentials or other authentication approved by Mehiläinen. Mehiläinen seeks to organise the Service and information security with appropriate technical solutions. Mehiläinen can make backups as long as OmaMehiläinen is valid for the User in question, but Mehiläinen does not guarantee copies of all data entries made by the User and is not otherwise responsible for backups in all situations. For the above reasons, each User is responsible for any backups that they deem necessary in all situations, both when using the Service and especially at the end of the Service.
When the use of OmaMehiläinen is discontinued, Mehiläinen deletes all data stored by the User concerning OmaMehiläinen and the User’s OmaMehiläinen profile, but the data concerning other services (such as feedback and data used to allocate services) remain in Mehiläinen’s customer register and the patient data in the separate patient register remain in a separate patient register.
The User undertakes to keep the login credentials confidential and immediately notify Mehiläinen’s Customer Service Centre if the credentials fall into the wrong hands or the User detects problems with the Service. Cookies are used in Mehiläinen’s online services in accordance with the terms of use of the websites. The Terms of Use can be found at www.mehilainen.fi/en/terms-and-conditions.
The User has the right to terminate the use of OmaMehiläinen at any time. The User must notify the termination in person by means of a notice signed at Mehiläinen’s medical clinic or by any other means indicated in the Service. Mehiläinen has the right, at its sole discretion, to change the content, prices and terms of the Service, to issue regulations on the use of the Service and, at its sole discretion, to restrict, suspend and also terminate the Service. Mehiläinen seeks to notify significant changes in connection with the Service. If the User continues to use the Service, this means accepting the changes.
If the User does not accept the changes, regulations or instructions, the User must immediately stop using the Service and declare that they will terminate the agreement as mentioned above. Prior to the possible termination of the Service, the Service and/or the email address provided by the User in the Service shall be notified. After the termination of the agreement and the Service, the User has no right to use the Service. After the decision, Mehiläinen has a reasonable time to close the Service for the User as well as to delete the data stored in the Service to the extent that there is no legal obligation to store the data.
These Terms and the Service are governed by Finnish law. Negotiations shall be the primary means of resolving any disputes. If the negotiations do not result in a satisfactory result, the disputes will be settled in the District Court of Helsinki. Health services are also subject to the general terms and conditions for health services, which can be found on Mehiläinen’s website www.mehilainen.fi/en.
The OmaMehiläinen service is organised by Mehiläinen Oy, Business ID 1927556-5 (“Mehiläinen”). All inquiries, comments, suggestions and other feedback concerning OmaMehiläinen must be made using the OmaMehiläinen link on the Internet in accordance with the instructions provided on the OmaMehiläinen website (www.mehilainen.fi/en).
